PA Consulting public statement in relation to the CNMC (Spanish Competition Authority) 2019 enquiry into the bidding practices of consulting companies in Spain
PA Consulting Services Limited has assisted the CNMC (Spanish Competition Authority) in its 2019 enquiry into the bidding practices of consulting companies in Spain, which included PA’s former branch in Spain.
We can confirm that PA Consulting Services Limited, Sucursal En España our former trading branch in Spain, has been found by the CNMC to have participated in a bidding cartel for consulting firms in Spain from March 2016 to March 2018. Once our UK senior management became aware of the activity, PA co-operated fully throughout the investigation with the CNMC. PA was the only company to cooperate with the CNMC. As a result of our co-operation any potential fine for PA was reduced, however, as we do not trade in Spain, no fine has been imposed.
It is disappointing that former employees were engaged in concerted bidding practices that were clearly against PA’s Code of Conduct. Alongside the CNMC enquiry, PA’s senior management team ordered an external review of all of its policies, strengthened its worldwide training and compliance programmes (especially in relation to ethical trading), dismissed the offending employees and closed the Spanish business. This has been shown to have been an isolated incident limited to the actions of a few individuals. PA does not tolerate any activity by its people that has the intention of distorting competition.
PA will offer to pay compensation to any government entity where these practices have been identified as part of a bid and shown that it suffered a damage resulting from the infringement.
